TERMS & CONDITIONS
All reservation services provided by and travel services coordinated by United Travel, LLC. are governed by and subject to these Terms and Conditions. By booking a reservation online using our website at www.UnitedTravelLLC.com (our “Website”) or through one of our representatives, or by making payment for a reservation made by you or on your behalf, you have agreed to and accepted these Terms and Conditions.
RESPONSIBILITY: You understand and assume responsibility that you are traveling at your own risk and United Travel, LLC does not assume any responsibility for, but not limited to, anything outside our control (weather, injury, illness, death, delays, illegal activity, etc).
You understand to review and confirm the laws and culture of the destintion(s) you're visiting and accept responsibility that it is up to you to follow said laws and culture for your destination(s). You understand not following said laws & cultures could end up with legal actions taken agaisnt you in your destination.
WEATHER: Depending on your travel destination, weather and climate could impact your travel plans. Keep in mind in the Atlantic, hurricane season runs June - November (with Aug-Nov usually being peak season) affecting destinations in the Caribbean. Rainy season is May - November in many Central American regions. The summer months (June-August) in Mexico & Caribbean are known to be extra hot and humid and tend to have an increase in Sargassum on the Caribbean side. It is your responsibility to weigh out the pros and cons of Mother Nature and her unpredictability. Make sure to check the annual weather and climate patterns for your travel location to see how they align with your travel dates.
HONEYMOON & ANNIVERSARY TRAVELERS: You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photocopy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your United Travel, LLC agent if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.
FINAL PAYMENT: The final payment MUST be received NO LATER THAN 60-90 days prior to departure. Final payments are not automatically charged. Please note your calendar of this final payment date as reminders may not be sent, however, we try to send reminders about a week before it’s due. You must go to http://www.unitedtravelllc.com/payment on the date you'd like the payment to be posted. United Travel, LLC is not responsible for cancellations due to payments made after this date. Late fees will apply.
CANCELLATION PENALTIES: Pertaining to the room portion of your trip; once your reservation is made a $100 non-refundable penalty will be assessed plus any additional resort penalties take effect. The aforementioned is per person or entire room canceling (so if 1 person within the room cancels these same rules apply for that person). Regarding Airline tickets: if United Travel, LLC booked your tickets, they are 100% non-refundable and subject to individual airline penalties/fees (see insurance below). Cancellation penalties will apply and unless otherwise noted if your trip is within 75 days it is 100% non-refundable. Please note group/wedding terms may override this term. If so, the trip is 100% non-refundable after the final payment date of the group as stipulated in said group/wedding.
CHARGEBACK: Your signed charge authorization is a binding agreement for charging your card, and as such you waive any right to a chargeback in the case of trip delays, changes, or cancellations for any cause (excepting fraud), including a force majeure event, and you agree to refund policies and procedures as outlined in the terms and conditions of the suppliers operating components of your trip. In the event that you attempt without our authorization to chargeback, reverse, or recollect a trip payment already made, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, without limitation, attorney fees.
LATE FEES: Final payments not received prior to the due date above will incur a $50 per person late fee. All reservations are subject to cancellation and hotel penalties as described above if the final payment is not received on the due date. Late fees are not covered by travel insurance and are always non-refundable. All the above would be protected with the optional Travel Insurance with the exception of late fees. If you do not have insurance – natural disasters (such as hurricanes), cancellations for ANY reason (medical/personal emergencies, cancellation of the wedding, etc.) do not relieve you from these penalties. ONLY Travel Insurance will ensure your coverage. All cancellations must be received in writing.
TRAVELING WITH CHILDREN: Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Please refer to this website for more information and sample letters: http://www.globetrektravel.com/minortravelforms.pdf United Travel, LLC is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.
TRAVEL DOCUMENTS: Travel documents will be sent to you no later than seven (7) days prior to departure date. Please read through these documents immediately; misprints, misspellings, incorrect dates, etc. are not the responsibility of United Travel, LLC. Included in your travel documents (if airfare is purchased through United Travel, LLC) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of check-in; online with the airline directly, or at the airport when showing passport & checking in luggage. It is very important that you take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply.
BAGGAGE FEES: Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's website for up-to-date fees & information. United Travel, LLC is NOT responsible for additional fees incurred for baggage or seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE! AIRLINE SCHEDULE CHANGES & CANCELLATIONS: Occasionally airlines change flight schedules, & may even cancel flights entirely. These changes are beyond United Travel, LLC control. In the event that such a situation occurs and your flights were booked with United Travel, LLC; United Travel, LLC will do it’s very best to assist you with finding best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). United Travel, LLC will notify you of major changes. Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. United Travel, LLC is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last-minute airline flight time changes within 24 hours of departure. United Travel, LLC is not responsible for changes that may occur within 24 hours of original flight departure time.
RE-CONFIRM YOUR FLIGHTS: United Travel, LLC advises you personally re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check-in online 24 hours prior to departure using the “Record Locator” (found in your United Travel, LLC documents if booked directly with United Travel, LLC)
AIRLINE CHECK-IN: Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time and (3) hours for international flights.
RESORT CHECK-IN: Check-in time at most resorts is 3:00 pm (local time). If you arrive prior to 3:00 pm your room may not be ready. The resort will store your luggage in a secure location on property so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy a nice lunch, swim in the pool, walk along the beach, etc. until you are notified that your room accommodation is ready for check-in.
DRESS CODE: Please be advised that some resort restaurants may require a dress code (i.e. long pants, collared shirts, & closed-toe shoes for men). Please pack accordingly.
HEALTH PANDEMICS & STATE OF EMERGENCIES: In the event of health pandemics or states of emergency, the suppliers operating your trip (for whom we act as sales agents) may change, delay, or cancel the services they offer for your trip at their sole discretion and with little or no advance notice. Also, government officials in the destinations you visit may change entry requirements, health protocols, and other rules for inbound visitors (including health screenings and tests and mandatory quarantines) at their discretion and with little or no advance notice. You agree that we as sales agents have no control over these decisions and we cannot be held liable for them. Further, you understand that it's your responsibility to comply with the government's rules in the destinations you're visiting that are in effect during your trip.
THIRD PARTY SUPPLIERS: United Travel, LLC. is only responsible for reserving the items listed in the reservation details. The third-party suppliers providing transportation, accommodations, sightseeing arrangements, tours, excursions and other components of your vacation or trip (collectively, “Suppliers”) are independent contractors and are not agents, affiliates, representatives or employees of United Travel, LLC., or any of its subsidiaries. United Travel, LLC. has no ownership interest in any Supplier. Any use of the United Travel, LLC. name by a Supplier is for identification purposes only and does not constitute ownership, agency, supervision or control by United Travel, LLC. All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier.
GROUPS: If you are traveling as part of a group of 5 or more rooms, different deposit, payment and cancellation policies may apply than those set forth in these Terms and Conditions. See your Group Sales Contract for details.
OTHER TRAVELERS OR CONTACTS: If you book services for other travelers, you must make sure that you have the right to do so. You must obtain the consent of other individuals who may accompany you prior to providing their names, as they may be unable to view or change any information you provide on their behalf. By providing the personal information of another traveler or third party, you represent that you have all necessary authority or have obtained all necessary consents from such person to enable us to collect, use, and disclose his or her personal information as set forth in our Privacy Policy.
RESERVATIONS AND PAYMENT: United Travel, LLC. accepts payment by credit cards issued on the following: American Express, Visa, Mastercard, or Discover. For land/air bookings paid by credit card, the supplier may split the payment between the resort and the air carrier booked. The land portion of the payment will be processed immediately and the airline will process payment at the time the air tickets are issued. Please note: Groups, Early Booking Bonus, and other special bookings may have different payment and cancellation policies and will be advised at time of reservation. If payment is not received by the due date, all components of the booking will be cancelled without a refund. A credit card authorization form (which can be found here http://unitedtravelllc.com/payment ) must be returned to your United Travel, LLC. agent in order to process any payments towards travel United Travel, LLC. is booking for you. United Travel, LLC. is not responsible for any penalties, fare increases or fees incurred due to any late payments, all of which must be paid by the traveler. Any other person or entity (including a travel agent) who receives monies from individual travelers does so strictly as an agent of such travelers.
LAST-MINUTE RESERVATIONS: Reservations are accepted up to 3 days prior to scheduled departure and subject to availability. Any reservations made 4 weeks or less prior to departure may require payment of a $50.00 Rush Booking fee.
RATES: All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at any time, without notice. United Travel, LLC. reserves the right to request to make adjustments on your behalf if a particular rate was incorrectly stated. United Travel, LLC. can guarantee rates only for reservations paid in full; therefore, it is recommended that full payment be made at time of booking. Airline tickets must be paid and issued to avoid rate increases, fuel surcharges, and cancellation of airline reservations. Government and Supplier-imposed taxes and fees are subject to increase at any time, must be paid by the traveler and are not the responsibility of United Travel, LLC.
QUOTED RATES DO NOT INCLUDE: Airline baggage charges, seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, resort fees, hotel energy surcharges, parking and valet fees, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included in our quoted fees, except where specifically noted.
REVISIONS AND CANCELLATIONS: Any revisions, changes, or cancellations made to a reservation may be subject to a fee of up to $100 per booking, in addition to concierge fees, any other Supplier charges and penalties. ANY changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. Most airlines consider a name change to be a cancellation. No refunds will be granted on unused or partially used services once travel has commenced. Depending on the nature of the revision/cancellation, travelers will need to provide appropriate documentation in order to request any refund.
NO SHOWS: Failure to travel without prior notification is considered a no-show. No show penalties can be up to the entire cost of reservation and are subject to policies and procedures of the travel Suppliers.
TRAVEL INSURANCE: Travel insurance is optional, but highly recommended. Coverage varies depending on individual travel need and policy. Insurance is due in full at time of booking and coverage begins at time of booking. Payment for cancel for any reason insurance is due in full at initial time of booking. A travel insurance quote will automatically be offered to you in a pricing proposal. United Travel, LLC. and its agents are not licensed insurance agents, but are authorized to sell a policy to protect your travel investment. Please contact the insurance company directly with policy questions. If you decline insurance you must do so in writing or by selecting decline on your vacation contract. If you decline to purchase travel insurance you fully understand that United Travel, LLC. is not liable or responsible for any expenses incurred as a result of cancellation & interruption, emergency medical/transportation, loss of baggage & personal effects, flight & travel accident, and/or rental car physical damage.
CANCEL FOR ANY REASON TRAVEL INSURANCE: Cancel for Any Reason Insurance can only be purchased at the time your reservation is made; it cannot be added after the initial trip deposit is received. Cancel for Any Reason Insurance starts from $64+ per adult, $50+ per child (2 to 12yrs of age at time of travel). Your United Travel, LLC Designer will quote your insurance policy cost upon initial trip quote. Cancel for Any Reason Insurance will allow you to cancel for any reason up to the morning of departure (prior to flight departure) with up to 75% refund (minus insurance policy cost). Insurance does NOT cover items you purchase outside United Travel, LLC (i.e. airfare, tours, excursions, etc) unless the cost is added to the policy. Please Note: if you initially reserve a room only package & add airfare to the package through United Travel, LLC at a later date your cancel for any reason insurance policy cost will be adjusted to accommodate the revised total trip package cost at that time. This plan does not include increased rates associated with a change in the number of individuals occupying a room. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. TRAVELER IDENTIFICATION AND PROOF OF CITIZENSHIP: The Transportation Security Administration (TSA) requires all airline passengers to provide the following Secure Flight Passenger Data (SFPD):
All US citizens traveling to or from any international destination via airline transportation must have a valid passport which must be valid for a minimum of six months beyond the return travel date. It is the traveler’s responsibility to verify current entry requirements and obtain the necessary travel documentation based on the country of origin, destination and any countries in which a stop is scheduled. Minors 17 and under traveling alone or with a single parent may be required to have additional documentation on international flights. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.
NOTICE OF AIRCRAFT CABIN INSECTICIDE TREATMENT: Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at: http://ostpxweb.dot.gov/policy/safetyenergyenv/disinsection.htm
AIR TRANSPORTATION & BAGGAGE FEES: United Travel, LLC. has no control over and assumes no liability for airline strikes, schedule changes, flight delays, flight cancellations, or other airline initiated changes. In the event of such an occurrence, the airline is responsible and will determine what action will be taken.
Baggage checked or carried on board an aircraft, vessel, or vehicle are subject to fees based on weight, number, and size. Many airlines have implemented a policy for charging for checked and/or carry-on baggage. These charges are payable directly to the carrier. Please contact your airline for exact details. United Travel, LLC. is not responsible or liable for any delay, loss, or damage to baggage and personal property.
ACCOMMODATIONS: Facilities, guest services, amenities, hotel energy surcharges, resort fees, and promotional offers are provided at the discretion of the hotel and are subject to change without notice. Any additional costs are the responsibility of the traveler and are payable directly to the hotel. Connecting rooms and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel descriptions and photos do not necessarily depict the actual room in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room standards are the sole responsibility of the hotel. Hotel ratings are based on information provided.
RENTAL CARS: Each rental day consists of one 24-hour period. Overtime charges must be paid directly to the car rental company (CRC). Car rentals do not include gas, collision damage waiver, drop charges, personal accident insurance, personal effects protection, car seats, additional driver fees, upgrades or extensions of rental beyond the period included. All CRC claims must be settled directly with the CRC. NOTE: A valid driver’s license and security deposit must be provided to the CRC. Minimum driver age varies by destination and type of vehicle. Underage drivers may be subject to an extra surcharge payable directly to the CRC.
PHYSICAL DISABILITIES: Travelers requiring special facilities, services or accommodations must disclose such needs to United Travel, LLC. at time of reservation. Wheelchair-accessible transportation and accommodations may be requested, but cannot be guaranteed, as accommodation standards vary by hotel and are not within the control of United Travel, LLC. Your foreign destination may not conform to the United States’ Americans with Disabilities Act requirements, and facilities for disabled persons may be extremely limited. United Travel, LLC. assumes no liability for the failure for the provision of accommodations by a travel vendor.
LIMITATION OF LIABILITY OF UNITED TRAVEL, LLC.:
NEITHER UNITED TRAVEL, LLC. NOR ANY OF ITS PARENT, AFFILIATES, SUBSIDIARIES, OR REPRESENTATIVES WILL BE OR BECOME LIABLE OR RESPONSIBLE IN ANY WAY, AND EACH OF THEM HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR, ANY LOSS, COSTS, EXPENSE, INJURY, ACCIDENT, OR DAMAGE TO PERSON OR PROPERTY RESULTING DIRECTLY OR INDIRECTLY FROM (I) THE ACTS OR OMISSIONS OF SUPPLIERS OR OTHER PROVIDERS OF GOODS OR SERVICES OR ANY OTHER THIRD PARTIES, INCLUDING, BUT NOT LIMITED TO, DELAYS OR CANCELLATION OF SERVICES, CESSATION OF OPERATIONS, BREAKDOWN IN MACHINERY OR EQUIPMENT, TECHNOLOGY PROBLEMS, OR CHANGES IN FARES, ITINERARIES OR SCHEDULES, AND/OR (II) ACTS OF GOD, FIRE, ACTS OF GOVERNMENT OR OTHER AUTHORITIES, WARS, ACTS OF TERRORISM, PIRACY, CIVIL UNREST, STRIKES, RIOTS, THEFTS, PILFERAGE, EPIDEMICS, QUARANTINES, OTHER DISEASE, CLIMATIC CONDITIONS, WEATHER, DANGERS/INCIDENTS TO ACTIVITIES OR FROM ANY OTHER CAUSE BEYOND UNITED TRAVEL, LLC. CONTROL.
WARRANTY DISCLAIMER
ALL RESERVATION SERVICES PROVIDED BY UNITED TRAVEL, LLC. AND ALL TRAVEL ITINERARIES OR SERVICES BOOKED THROUGH UNITED TRAVEL, LLC. THROUGH OUR WEBSITE OR THROUGH OUR REPRESENTATIVES OR OTHERWISE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND ARE SUBJECT TO ANY AND ALL APPLICABLE LAWS, REGULATIONS, TARIFFS AND THE TERMS AND CONDITIONS OF ANY AGREEMENT OR ARRANGEMENT WITH SUPPLIERS OR PROVIDERS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, UNITED TRAVEL, LLC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND SECURITY AND ACCURACY AND ALSO ALL WARRANTIES ARISING BY USAGE OF TRADE AND COURSE OF DEALING. UNITED TRAVEL, LLC. MAKES NO WARRANTY, AND EXPRESSLY DISCLAIMS ANY OBLIGATION THAT UNITED TRAVEL, LLC. WEBSITE OR SERVICES WILL MEET YOUR REQUIREMENTS OR WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS OR WILL BE UP-TO-DATE, COMPLETE, COMPREHENSIVE, ACCURATE OR APPLICABLE TO YOUR CIRCUMSTANCE OR THAT THE QUALITY OF ANY PRODUCT, ITINERARY, SERVICE, INFORMATION OR MATERIAL OBTAINED FROM OR THROUGH UNITED TRAVEL, LLC. WEBSITE OR SERVICES WILL MEET YOUR EXPECTATIONS.
LIMITATION ON DAMAGES
YOU ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, NEITHER UNITED TRAVEL, LLC. NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, PARTNERS, SUPPLIERS, OR PROVIDERS WILL BE RESPONSIBLE OR LIABLE FOR: (A) ANY DAMAGES TO OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY AS A RESULT OF YOUR ACCESS TO OR USE OF THE UNITED TRAVEL, LLC. WEBSITE, YOUR DOWNLOADING OF ANY CONTENT FROM THE UNITED TRAVEL, LLC. WEBSITE OR YOUR USE OF ANY UNITED TRAVEL, LLC. SERVICE; OR (B) ANY INJURY, DEATH, DAMAGE, LOSS, CLAIM, ACT OF GOD, ACCIDENT, DELAY OR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, LOSS OR THEFT OF DATA OR RECORDS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, LOST PROFITS AND LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT, ANY OTHER CONTRACT BETWEEN UNITED TRAVEL, LLC. AND YOU OR YOUR USE OF THE UNITED TRAVEL, LLC. WEBSITE, ANY UNITED TRAVEL, LLC. SERVICES OR THE PERFORMANCE OR NON-PERFORMANCE OR DELAY IN PERFORMANCE BY UNITED TRAVEL, LLC. OR ANY PARTNER, SUPPLIER OR PROVIDER, EVEN IF UNITED TRAVEL, LLC. HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES ARISING FROM USE OF THE UNITED TRAVEL, LLC. WEBSITE OR UNITED TRAVEL, LLC. SERVICES OR FROM SUCH PERFORMANCE OR NON-PERFORMANCE. IF ANY ITINERARY OR PART THEREOF BOOKED THROUGH UNITED TRAVEL, LLC. IS CANCELLED BY UNITED TRAVEL, LLC. OR ANY SUPPLIER OR PROVIDER, UNITED TRAVEL, LLC. LIABILITY, IF ANY, RESULTING FROM SUCH CANCELLATION SHALL NOT EXCEED A REFUND OF THE AMOUNTS RECEIVED BY UNITED TRAVEL, LLC. FROM YOU FOR THE ITINERARY OR PART THEREOF CANCELLED. BAGGAGE AND OTHER PERSONAL BELONGINGS ARE THE TRAVELER’S RESPONSIBILITY OR THAT OF THE SUPPLIER OR PROVIDER, NOT UNITED TRAVEL, LLC.
IF, DESPITE THE LIMITATION OF LIABILITY SET FORTH ABOVE, UNITED TRAVEL, LLC. OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, PARTNERS, SUPPLIERS, OR PROVIDERS IS OR ARE FOUND TO BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF OR RELATING IN ANY WAY TO ANY OF THE OCCURRENCES DESCRIBED ABOVE, THEN, TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE LIABILITY WILL IN NO EVENT EXCEED THE GREATER OF (A) THE TOTAL PACKAGE PRICE PAID TO UNITED TRAVEL, LLC. IN CONNECTION WITH THIS TRANSACTION OR (B) ONE-HUNDRED DOLLARS (US $100.00) OR THE EQUIVALENT OF LOCAL CURRENCY (THE “MAXIMUM LIABILITY”).

You agree to defend, indemnify and hold harmless United Travel, LLC. and its officers, directors, employees, representatives, affiliates, partners, Suppliers and providers from and against any claim, cause of action and/or demand, including, without limitation, costs, expenses and reasonable attorneys’, accountants’ and expert fees incurred in connection with such claim, cause of action and/or demand, commenced by you for an amount in excess of the Maximum Liability or any claim, cause of action and/or demand commenced by any third party arising from or relating to: (A) your breach of these Terms and Conditions or any other contract between United Travel, LLC. and you, including but not limited to, any applicable Group Sales Contract or our Terms and Conditions (B) your negligence; (C) your violation of any law or the rights of a third party; (D) your use of our Website or (E) any other act or omission by you.
SELLER OF TRAVEL: For Customers Purchasing Travel in the State of California: Please request our California Seller of Travel Registration Number. For Customers Purchasing Travel in the State of Iowa: Please request our Iowa Seller of Travel Registration Number.
CHOICE OF LAW; CONSENT TO JURISDICTION: These Terms and Conditions constitute a legal and binding agreement (“Agreement”) between you and United Travel, LLC., which is governed by the internal laws of each State of United Travel, LLC. business residence, without regard to its choice of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement, including these Terms and Conditions, nor shall it apply to your use of our Website or the Website Terms of Use. To the extent permitted by applicable law, you hereby consent and submit to the exclusive jurisdiction of and venue in the State and Federal courts located in each United Travel, LLC. state of residence for all claims and actions arising out of or relating to this Agreement, including these Terms and Conditions, or to your use of our website, including the Website Terms of Use. The prevailing party in such claim or action shall be entitled to recover all reasonable costs, expenses and attorneys’ fees incurred in connection with such claim or action. TO THE EXTENT PERMITTED BY LAW, WE BOTH AGREE TO WAIVE THE RIGHT TO TRIAL BY JURY FOR ALL SUCH ACTIONS AND CLAIMS AND THAT ALL SUCH CLAIMS OR ACTIONS WILL BE HANDLED AND RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

RESPONSIBILITY: You understand and assume responsibility that you are traveling at your own risk and United Travel, LLC does not assume any responsibility for, but not limited to, anything outside our control (weather, injury, illness, death, delays, illegal activity, etc).
You understand to review and confirm the laws and culture of the destintion(s) you're visiting and accept responsibility that it is up to you to follow said laws and culture for your destination(s). You understand not following said laws & cultures could end up with legal actions taken agaisnt you in your destination.
WEATHER: Depending on your travel destination, weather and climate could impact your travel plans. Keep in mind in the Atlantic, hurricane season runs June - November (with Aug-Nov usually being peak season) affecting destinations in the Caribbean. Rainy season is May - November in many Central American regions. The summer months (June-August) in Mexico & Caribbean are known to be extra hot and humid and tend to have an increase in Sargassum on the Caribbean side. It is your responsibility to weigh out the pros and cons of Mother Nature and her unpredictability. Make sure to check the annual weather and climate patterns for your travel location to see how they align with your travel dates.
HONEYMOON & ANNIVERSARY TRAVELERS: You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photocopy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your United Travel, LLC agent if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.
FINAL PAYMENT: The final payment MUST be received NO LATER THAN 60-90 days prior to departure. Final payments are not automatically charged. Please note your calendar of this final payment date as reminders may not be sent, however, we try to send reminders about a week before it’s due. You must go to http://www.unitedtravelllc.com/payment on the date you'd like the payment to be posted. United Travel, LLC is not responsible for cancellations due to payments made after this date. Late fees will apply.
CANCELLATION PENALTIES: Pertaining to the room portion of your trip; once your reservation is made a $100 non-refundable penalty will be assessed plus any additional resort penalties take effect. The aforementioned is per person or entire room canceling (so if 1 person within the room cancels these same rules apply for that person). Regarding Airline tickets: if United Travel, LLC booked your tickets, they are 100% non-refundable and subject to individual airline penalties/fees (see insurance below). Cancellation penalties will apply and unless otherwise noted if your trip is within 75 days it is 100% non-refundable. Please note group/wedding terms may override this term. If so, the trip is 100% non-refundable after the final payment date of the group as stipulated in said group/wedding.
CHARGEBACK: Your signed charge authorization is a binding agreement for charging your card, and as such you waive any right to a chargeback in the case of trip delays, changes, or cancellations for any cause (excepting fraud), including a force majeure event, and you agree to refund policies and procedures as outlined in the terms and conditions of the suppliers operating components of your trip. In the event that you attempt without our authorization to chargeback, reverse, or recollect a trip payment already made, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, without limitation, attorney fees.
LATE FEES: Final payments not received prior to the due date above will incur a $50 per person late fee. All reservations are subject to cancellation and hotel penalties as described above if the final payment is not received on the due date. Late fees are not covered by travel insurance and are always non-refundable. All the above would be protected with the optional Travel Insurance with the exception of late fees. If you do not have insurance – natural disasters (such as hurricanes), cancellations for ANY reason (medical/personal emergencies, cancellation of the wedding, etc.) do not relieve you from these penalties. ONLY Travel Insurance will ensure your coverage. All cancellations must be received in writing.
TRAVELING WITH CHILDREN: Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Please refer to this website for more information and sample letters: http://www.globetrektravel.com/minortravelforms.pdf United Travel, LLC is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.
TRAVEL DOCUMENTS: Travel documents will be sent to you no later than seven (7) days prior to departure date. Please read through these documents immediately; misprints, misspellings, incorrect dates, etc. are not the responsibility of United Travel, LLC. Included in your travel documents (if airfare is purchased through United Travel, LLC) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of check-in; online with the airline directly, or at the airport when showing passport & checking in luggage. It is very important that you take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply.
BAGGAGE FEES: Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's website for up-to-date fees & information. United Travel, LLC is NOT responsible for additional fees incurred for baggage or seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE! AIRLINE SCHEDULE CHANGES & CANCELLATIONS: Occasionally airlines change flight schedules, & may even cancel flights entirely. These changes are beyond United Travel, LLC control. In the event that such a situation occurs and your flights were booked with United Travel, LLC; United Travel, LLC will do it’s very best to assist you with finding best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). United Travel, LLC will notify you of major changes. Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. United Travel, LLC is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last-minute airline flight time changes within 24 hours of departure. United Travel, LLC is not responsible for changes that may occur within 24 hours of original flight departure time.
RE-CONFIRM YOUR FLIGHTS: United Travel, LLC advises you personally re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check-in online 24 hours prior to departure using the “Record Locator” (found in your United Travel, LLC documents if booked directly with United Travel, LLC)
AIRLINE CHECK-IN: Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time and (3) hours for international flights.
RESORT CHECK-IN: Check-in time at most resorts is 3:00 pm (local time). If you arrive prior to 3:00 pm your room may not be ready. The resort will store your luggage in a secure location on property so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy a nice lunch, swim in the pool, walk along the beach, etc. until you are notified that your room accommodation is ready for check-in.
DRESS CODE: Please be advised that some resort restaurants may require a dress code (i.e. long pants, collared shirts, & closed-toe shoes for men). Please pack accordingly.
HEALTH PANDEMICS & STATE OF EMERGENCIES: In the event of health pandemics or states of emergency, the suppliers operating your trip (for whom we act as sales agents) may change, delay, or cancel the services they offer for your trip at their sole discretion and with little or no advance notice. Also, government officials in the destinations you visit may change entry requirements, health protocols, and other rules for inbound visitors (including health screenings and tests and mandatory quarantines) at their discretion and with little or no advance notice. You agree that we as sales agents have no control over these decisions and we cannot be held liable for them. Further, you understand that it's your responsibility to comply with the government's rules in the destinations you're visiting that are in effect during your trip.
THIRD PARTY SUPPLIERS: United Travel, LLC. is only responsible for reserving the items listed in the reservation details. The third-party suppliers providing transportation, accommodations, sightseeing arrangements, tours, excursions and other components of your vacation or trip (collectively, “Suppliers”) are independent contractors and are not agents, affiliates, representatives or employees of United Travel, LLC., or any of its subsidiaries. United Travel, LLC. has no ownership interest in any Supplier. Any use of the United Travel, LLC. name by a Supplier is for identification purposes only and does not constitute ownership, agency, supervision or control by United Travel, LLC. All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier.
GROUPS: If you are traveling as part of a group of 5 or more rooms, different deposit, payment and cancellation policies may apply than those set forth in these Terms and Conditions. See your Group Sales Contract for details.
OTHER TRAVELERS OR CONTACTS: If you book services for other travelers, you must make sure that you have the right to do so. You must obtain the consent of other individuals who may accompany you prior to providing their names, as they may be unable to view or change any information you provide on their behalf. By providing the personal information of another traveler or third party, you represent that you have all necessary authority or have obtained all necessary consents from such person to enable us to collect, use, and disclose his or her personal information as set forth in our Privacy Policy.
RESERVATIONS AND PAYMENT: United Travel, LLC. accepts payment by credit cards issued on the following: American Express, Visa, Mastercard, or Discover. For land/air bookings paid by credit card, the supplier may split the payment between the resort and the air carrier booked. The land portion of the payment will be processed immediately and the airline will process payment at the time the air tickets are issued. Please note: Groups, Early Booking Bonus, and other special bookings may have different payment and cancellation policies and will be advised at time of reservation. If payment is not received by the due date, all components of the booking will be cancelled without a refund. A credit card authorization form (which can be found here http://unitedtravelllc.com/payment ) must be returned to your United Travel, LLC. agent in order to process any payments towards travel United Travel, LLC. is booking for you. United Travel, LLC. is not responsible for any penalties, fare increases or fees incurred due to any late payments, all of which must be paid by the traveler. Any other person or entity (including a travel agent) who receives monies from individual travelers does so strictly as an agent of such travelers.
LAST-MINUTE RESERVATIONS: Reservations are accepted up to 3 days prior to scheduled departure and subject to availability. Any reservations made 4 weeks or less prior to departure may require payment of a $50.00 Rush Booking fee.
RATES: All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at any time, without notice. United Travel, LLC. reserves the right to request to make adjustments on your behalf if a particular rate was incorrectly stated. United Travel, LLC. can guarantee rates only for reservations paid in full; therefore, it is recommended that full payment be made at time of booking. Airline tickets must be paid and issued to avoid rate increases, fuel surcharges, and cancellation of airline reservations. Government and Supplier-imposed taxes and fees are subject to increase at any time, must be paid by the traveler and are not the responsibility of United Travel, LLC.
QUOTED RATES DO NOT INCLUDE: Airline baggage charges, seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, resort fees, hotel energy surcharges, parking and valet fees, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included in our quoted fees, except where specifically noted.
REVISIONS AND CANCELLATIONS: Any revisions, changes, or cancellations made to a reservation may be subject to a fee of up to $100 per booking, in addition to concierge fees, any other Supplier charges and penalties. ANY changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. Most airlines consider a name change to be a cancellation. No refunds will be granted on unused or partially used services once travel has commenced. Depending on the nature of the revision/cancellation, travelers will need to provide appropriate documentation in order to request any refund.
NO SHOWS: Failure to travel without prior notification is considered a no-show. No show penalties can be up to the entire cost of reservation and are subject to policies and procedures of the travel Suppliers.
TRAVEL INSURANCE: Travel insurance is optional, but highly recommended. Coverage varies depending on individual travel need and policy. Insurance is due in full at time of booking and coverage begins at time of booking. Payment for cancel for any reason insurance is due in full at initial time of booking. A travel insurance quote will automatically be offered to you in a pricing proposal. United Travel, LLC. and its agents are not licensed insurance agents, but are authorized to sell a policy to protect your travel investment. Please contact the insurance company directly with policy questions. If you decline insurance you must do so in writing or by selecting decline on your vacation contract. If you decline to purchase travel insurance you fully understand that United Travel, LLC. is not liable or responsible for any expenses incurred as a result of cancellation & interruption, emergency medical/transportation, loss of baggage & personal effects, flight & travel accident, and/or rental car physical damage.
CANCEL FOR ANY REASON TRAVEL INSURANCE: Cancel for Any Reason Insurance can only be purchased at the time your reservation is made; it cannot be added after the initial trip deposit is received. Cancel for Any Reason Insurance starts from $64+ per adult, $50+ per child (2 to 12yrs of age at time of travel). Your United Travel, LLC Designer will quote your insurance policy cost upon initial trip quote. Cancel for Any Reason Insurance will allow you to cancel for any reason up to the morning of departure (prior to flight departure) with up to 75% refund (minus insurance policy cost). Insurance does NOT cover items you purchase outside United Travel, LLC (i.e. airfare, tours, excursions, etc) unless the cost is added to the policy. Please Note: if you initially reserve a room only package & add airfare to the package through United Travel, LLC at a later date your cancel for any reason insurance policy cost will be adjusted to accommodate the revised total trip package cost at that time. This plan does not include increased rates associated with a change in the number of individuals occupying a room. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. TRAVELER IDENTIFICATION AND PROOF OF CITIZENSHIP: The Transportation Security Administration (TSA) requires all airline passengers to provide the following Secure Flight Passenger Data (SFPD):
- Full Name as it Appears on Government-Issued I.D.
- Date of Birth
- Gender
- Redress Number (If Available)
All US citizens traveling to or from any international destination via airline transportation must have a valid passport which must be valid for a minimum of six months beyond the return travel date. It is the traveler’s responsibility to verify current entry requirements and obtain the necessary travel documentation based on the country of origin, destination and any countries in which a stop is scheduled. Minors 17 and under traveling alone or with a single parent may be required to have additional documentation on international flights. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.
NOTICE OF AIRCRAFT CABIN INSECTICIDE TREATMENT: Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at: http://ostpxweb.dot.gov/policy/safetyenergyenv/disinsection.htm
AIR TRANSPORTATION & BAGGAGE FEES: United Travel, LLC. has no control over and assumes no liability for airline strikes, schedule changes, flight delays, flight cancellations, or other airline initiated changes. In the event of such an occurrence, the airline is responsible and will determine what action will be taken.
Baggage checked or carried on board an aircraft, vessel, or vehicle are subject to fees based on weight, number, and size. Many airlines have implemented a policy for charging for checked and/or carry-on baggage. These charges are payable directly to the carrier. Please contact your airline for exact details. United Travel, LLC. is not responsible or liable for any delay, loss, or damage to baggage and personal property.
ACCOMMODATIONS: Facilities, guest services, amenities, hotel energy surcharges, resort fees, and promotional offers are provided at the discretion of the hotel and are subject to change without notice. Any additional costs are the responsibility of the traveler and are payable directly to the hotel. Connecting rooms and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel descriptions and photos do not necessarily depict the actual room in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room standards are the sole responsibility of the hotel. Hotel ratings are based on information provided.
RENTAL CARS: Each rental day consists of one 24-hour period. Overtime charges must be paid directly to the car rental company (CRC). Car rentals do not include gas, collision damage waiver, drop charges, personal accident insurance, personal effects protection, car seats, additional driver fees, upgrades or extensions of rental beyond the period included. All CRC claims must be settled directly with the CRC. NOTE: A valid driver’s license and security deposit must be provided to the CRC. Minimum driver age varies by destination and type of vehicle. Underage drivers may be subject to an extra surcharge payable directly to the CRC.
PHYSICAL DISABILITIES: Travelers requiring special facilities, services or accommodations must disclose such needs to United Travel, LLC. at time of reservation. Wheelchair-accessible transportation and accommodations may be requested, but cannot be guaranteed, as accommodation standards vary by hotel and are not within the control of United Travel, LLC. Your foreign destination may not conform to the United States’ Americans with Disabilities Act requirements, and facilities for disabled persons may be extremely limited. United Travel, LLC. assumes no liability for the failure for the provision of accommodations by a travel vendor.
LIMITATION OF LIABILITY OF UNITED TRAVEL, LLC.:
NEITHER UNITED TRAVEL, LLC. NOR ANY OF ITS PARENT, AFFILIATES, SUBSIDIARIES, OR REPRESENTATIVES WILL BE OR BECOME LIABLE OR RESPONSIBLE IN ANY WAY, AND EACH OF THEM HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR, ANY LOSS, COSTS, EXPENSE, INJURY, ACCIDENT, OR DAMAGE TO PERSON OR PROPERTY RESULTING DIRECTLY OR INDIRECTLY FROM (I) THE ACTS OR OMISSIONS OF SUPPLIERS OR OTHER PROVIDERS OF GOODS OR SERVICES OR ANY OTHER THIRD PARTIES, INCLUDING, BUT NOT LIMITED TO, DELAYS OR CANCELLATION OF SERVICES, CESSATION OF OPERATIONS, BREAKDOWN IN MACHINERY OR EQUIPMENT, TECHNOLOGY PROBLEMS, OR CHANGES IN FARES, ITINERARIES OR SCHEDULES, AND/OR (II) ACTS OF GOD, FIRE, ACTS OF GOVERNMENT OR OTHER AUTHORITIES, WARS, ACTS OF TERRORISM, PIRACY, CIVIL UNREST, STRIKES, RIOTS, THEFTS, PILFERAGE, EPIDEMICS, QUARANTINES, OTHER DISEASE, CLIMATIC CONDITIONS, WEATHER, DANGERS/INCIDENTS TO ACTIVITIES OR FROM ANY OTHER CAUSE BEYOND UNITED TRAVEL, LLC. CONTROL.
WARRANTY DISCLAIMER
ALL RESERVATION SERVICES PROVIDED BY UNITED TRAVEL, LLC. AND ALL TRAVEL ITINERARIES OR SERVICES BOOKED THROUGH UNITED TRAVEL, LLC. THROUGH OUR WEBSITE OR THROUGH OUR REPRESENTATIVES OR OTHERWISE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND ARE SUBJECT TO ANY AND ALL APPLICABLE LAWS, REGULATIONS, TARIFFS AND THE TERMS AND CONDITIONS OF ANY AGREEMENT OR ARRANGEMENT WITH SUPPLIERS OR PROVIDERS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, UNITED TRAVEL, LLC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND SECURITY AND ACCURACY AND ALSO ALL WARRANTIES ARISING BY USAGE OF TRADE AND COURSE OF DEALING. UNITED TRAVEL, LLC. MAKES NO WARRANTY, AND EXPRESSLY DISCLAIMS ANY OBLIGATION THAT UNITED TRAVEL, LLC. WEBSITE OR SERVICES WILL MEET YOUR REQUIREMENTS OR WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS OR WILL BE UP-TO-DATE, COMPLETE, COMPREHENSIVE, ACCURATE OR APPLICABLE TO YOUR CIRCUMSTANCE OR THAT THE QUALITY OF ANY PRODUCT, ITINERARY, SERVICE, INFORMATION OR MATERIAL OBTAINED FROM OR THROUGH UNITED TRAVEL, LLC. WEBSITE OR SERVICES WILL MEET YOUR EXPECTATIONS.
LIMITATION ON DAMAGES
YOU ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, NEITHER UNITED TRAVEL, LLC. NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, PARTNERS, SUPPLIERS, OR PROVIDERS WILL BE RESPONSIBLE OR LIABLE FOR: (A) ANY DAMAGES TO OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY AS A RESULT OF YOUR ACCESS TO OR USE OF THE UNITED TRAVEL, LLC. WEBSITE, YOUR DOWNLOADING OF ANY CONTENT FROM THE UNITED TRAVEL, LLC. WEBSITE OR YOUR USE OF ANY UNITED TRAVEL, LLC. OR ANY PARTNER, SUPPLIER OR PROVIDER, EVEN IF UNITED TRAVEL, LLC. HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES ARISING FROM USE OF THE UNITED TRAVEL, LLC. WEBSITE OR UNITED TRAVEL, LLC. OR ANY SUPPLIER OR PROVIDER, UNITED TRAVEL, LLC. LIABILITY, IF ANY, RESULTING FROM SUCH CANCELLATION SHALL NOT EXCEED A REFUND OF THE AMOUNTS RECEIVED BY UNITED TRAVEL, LLC. FROM YOU FOR THE ITINERARY OR PART THEREOF CANCELLED. BAGGAGE AND OTHER PERSONAL BELONGINGS ARE THE TRAVELER’S RESPONSIBILITY OR THAT OF THE SUPPLIER OR PROVIDER, NOT UNITED TRAVEL, LLC.
IF, DESPITE THE LIMITATION OF LIABILITY SET FORTH ABOVE, UNITED TRAVEL, LLC. OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, PARTNERS, SUPPLIERS, OR PROVIDERS IS OR ARE FOUND TO BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF OR RELATING IN ANY WAY TO ANY OF THE OCCURRENCES DESCRIBED ABOVE, THEN, TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE LIABILITY WILL IN NO EVENT EXCEED THE GREATER OF (A) THE TOTAL PACKAGE PRICE PAID TO UNITED TRAVEL, LLC. IN CONNECTION WITH THIS TRANSACTION OR (B) ONE-HUNDRED DOLLARS (US $100.00) OR THE EQUIVALENT OF LOCAL CURRENCY (THE “MAXIMUM LIABILITY”).
Indemnity
You agree to defend, indemnify and hold harmless United Travel, LLC. and its officers, directors, employees, representatives, affiliates, partners, Suppliers and providers from and against any claim, cause of action and/or demand, including, without limitation, costs, expenses and reasonable attorneys’, accountants’ and expert fees incurred in connection with such claim, cause of action and/or demand, commenced by you for an amount in excess of the Maximum Liability or any claim, cause of action and/or demand commenced by any third party arising from or relating to: (A) your breach of these Terms and Conditions or any other contract between United Travel, LLC. and you, including but not limited to, any applicable Group Sales Contract or our Terms and Conditions (B) your negligence; (C) your violation of any law or the rights of a third party; (D) your use of our Website or (E) any other act or omission by you.
SELLER OF TRAVEL: For Customers Purchasing Travel in the State of California: Please request our California Seller of Travel Registration Number. For Customers Purchasing Travel in the State of Iowa: Please request our Iowa Seller of Travel Registration Number.
CHOICE OF LAW; CONSENT TO JURISDICTION: These Terms and Conditions constitute a legal and binding agreement (“Agreement”) between you and United Travel, LLC., which is governed by the internal laws of each State of United Travel, LLC. business residence, without regard to its choice of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement, including these Terms and Conditions, nor shall it apply to your use of our Website or the Website Terms of Use. To the extent permitted by applicable law, you hereby consent and submit to the exclusive jurisdiction of and venue in the State and Federal courts located in each United Travel, LLC. state of residence for all claims and actions arising out of or relating to this Agreement, including these Terms and Conditions, or to your use of our website, including the Website Terms of Use. The prevailing party in such claim or action shall be entitled to recover all reasonable costs, expenses and attorneys’ fees incurred in connection with such claim or action. TO THE EXTENT PERMITTED BY LAW, WE BOTH AGREE TO WAIVE THE RIGHT TO TRIAL BY JURY FOR ALL SUCH ACTIONS AND CLAIMS AND THAT ALL SUCH CLAIMS OR ACTIONS WILL BE HANDLED AND RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
